Mad Irishman Productions License Agreement
By using or installing this software, you agree to be bound by the terms of this Agreement.
1: License Grant
Number of Users: In consideration for the license fee paid, Mad Irishman Productions grants to you only, the Licensee, the non-exclusive, nontransferable right to use and display the Mad Irishman Productions product purchased through this service. If you are using this product for your work, this agreement applies to your employer. Mad Irishman Productions software may be used on one CPU at your site connected to any number of printers or other image producing devices at that site.
Third Parties: You may send a copy of any font for which you hold a license along with your documents to a commercial printer or other service bureau to enable the editing or printing of your document, provided that such party agrees to erase those fonts or images from their storage media and accepts liability for any misuse or appropriation of the font. You may also embed fonts within your documents for the viewing, editing, and printing of those documents, again providing that any actual transfer of font software is restricted as above.
Modifications. You may not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Mad Irishman Productions product without prior written consent from Mad Irishman Productions.
Backups: You may make one (1) copy of this Mad Irishman Productions product solely for backup purposes provided the copyright and trademark notices are reproduced in their entirety on the backup copy.
Rights Reservation. All contents of this package are Copyright 2002 by Mad Irishman Productions.
Mad Irishman Productions reserves all rights not specifically granted to Licensee.
2: Copyright
This Mad Irishman Productions product and the accompanying materials are copyrighted and contain proprietary information and trade secrets of Mad Irishman Productions. Unauthorized copying of the product even if modified, merged, or included with other software, or of the written materials, is expressly forbidden. You may be held legally responsible for any infringement of Mad Irishman Productions intellectual property rights that is caused or encouraged by your failure to abide by the terms of this Agreement.
3: Termination
This Agreement is effective until terminated. This Agreement will terminate automatically without notice from Mad Irishman Productions if you fail to comply with any provision contained herein. Upon termination, you must destroy the written materials, the Mad Irishman Productions product, and all copies of them, in part and in whole, including modified copies, if any.
4: Upgrades
Mad Irishman Productions periodically updates many Mad Irishman Productions products. As a licensed user you are entitled to upgrades for free or at a discounted upgrade price.
5. Limited Warranty
Mad Irishman Productions warrants the Mad Irishman Productions Product to be free from defects in materials and workmanship under normal use for a period of thirty (30) days from the date of delivery as shown on your invoice. Mad Irishman Productions' entire liability and your exclusive remedy as to a defective product shall be, at Mad Irishman Productions' option, either return of purchase price or replacement of any such product that is returned to Mad Irishman Productions with a copy of the invoice. Mad Irishman Productions shall have no responsibility to replace the product or refund the purchase price if failure results from accident, abuse or misapplication, or if any product is lost or damaged due to theft, fire, or negligence. Any replacement product will be warranted for thirty (30) days.
In all other ways this product is provided "as is". Mad Irishman Productions does not make any warranty of any kind, either expressed or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose. Mad Irishman Productions does not warrant that the functions contained in the Mad Irishman Productions Product will meet your requirements or that the operation of the software will be uninterrupted or error free.
Under no circumstances and under no legal theory, tort, contract, or otherwise, shall Mad Irishman Productions or its suppliers or resellers be liable to you or any other person for any indirect, special, incidental, or consequential damages of any character including, without limitation, damages for loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses.
This Agreement represents the complete agreement concerning this license between the parties and supersedes all prior agreements and representations between them. It may be amended only by a writing executed by both parties. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable. This Agreement shall be governed by and construed under the laws of the State of North Carolina.
