End User Licence Agreement (EULA) for usage of Hungarumlaut Font Software.
This is a legal agreement between You and Hungarumlaut. By downloading, installing and using font software You have to make sure you understand and agree to everything stated below.
1 Definitions
In this Agreement, ÒFontÓ, ÒFontsÓ or ÒFont SoftwareÓ have identical meanings and are defined as the designs of the Fonts and the software that produces a typeface design(s) together with any other artworks that may be associated with the Font.
ÒYouÓ, ÒYourÓ and the ÒEnd UserÓ are defined as and refer to a customer who has purchased a license to use the Font. An End User is not defined as a distributor, reseller, dealer, sub-licensee, original equipment manufacturer, or other wholesale buyer, etc.
ÒOutput DeviceÓ is defined as any device producing a usable representation of the Font, such as, but not limited to: a printer, image setter, laser setter, plate maker.
2 Permitted uses and restrictions
Installation:
Font software may be installed and used on one (1) desktop device and one (1) portable device that remains at a single location, are in ownership of the user authorised under this licence. These devices may be connected to any number of output devices (like laser or inkjet printer). However, font software may be downloaded to memory (hard disk or RAM) of only one (1) output device and user has to undertake that font software will be sufficiently secured against its illegal acquisition.
Back-up copies:
You may make a copy of the Font Software for back-up purposes only. Any copies must contain the same documentation, copyright, trademark, and other proprietary notices that appear on, in or with the Fonts. As a best practice, a copy of the sales receipt should always be included with the Fonts.
Allowed uses:
You may use the licensed fonts to create images on any surface such as computer screens, paper, photographs, movie credits, printed material, T-shirts, and other surfaces where the image is a fixed size.
You may use the licensed fonts to create EPS files or other scalable drawings provided that such files are only used by the household or company licensing the font.
Modifications:
You may create outline artworks based upon the Font Software for your personal or business use. However, the use of any font creation or font manipulation program or any attempt to modify the Font for the purposes of creating a usable or substitute version of the Font is prohibited. Under no circumstances may you modify, adapt, translate, reverse engineer, decompile, disassemble, alter, or otherwise attempt to discover the source code of the Font Software. Any modifications made to the vector outlines shall be considered derivative works and their use governed by the terms and conditions of this Agreement. You further agree not to commission or authorize any third party to undertake modifications to the Fonts without prior written consent from Hungarumlaut.
Embedding of font software:
Embedding of font software into digital documents or web pages is permitted only in secured read-only mode. User has to secure that it will be impossible to gain font software by any means or to copy it from these documents.
Third parties:
You may provide the font to a graphic designer, printer or other service bureau that is working on your behalf only if they agree to use the font exclusively for your work, agree to the terms of this license, and retain no copies of the font on completion of the work.
You may not provide the font or make it accessible to any other third parties.
3 Copyright
You expressly acknowledge that the Font Software, the designs embodied therein, the trade names and/or trademarks and copyrights associated therewith are each the exclusive property of Hungarumlaut.
You agree that the Fonts, and all copies thereof, are owned by Hungarumlaut and the FontÕs structure, organization and code are the valuable trade secrets of Hungarumlaut.
Unauthorized copying of the Product even if modified, merged, or included with other software, or of the written materials, is expressly forbidden. You may be held legally responsible for any infringement of the foundryÕs intellectual property rights that is caused or encouraged by your failure to abide by the terms of this Agreement.
4 Support and updates:
Hungarunlaut may, from time to time, update the product. Even though we try to provide free upgrades to previous product owners, product upgrade pricing may apply.
5 Guarantee
Font software will be repaired or replaced only if defective. You must notify provider of licence that font software is defective within the period of 30 days after its download. Guarantee shall not be applied to converted, modified or otherwise changed font software. Guarantee shall not cover assurance of performance, result or marketability of product with usage of font software, nor applicability of purchase for particular purpose. Hungarumlaut is not obliged to compensate for font software or return paid amount, if its malfunction was caused by accident, abuse or loss of font software as a result of theft, natural disaster, negligence etc. Hungarumlaut shall in no event be liable for any consequential, indirect, incidental, criminal or other special damages (loss of business profits, loss of business information etc.).
6 Termination of Licence
This Agreement is effective until terminated. This Agreement will terminate automatically without notice from Hungarumlaut if you fail to comply with any provision contained herein. Upon termination, you must destroy the written materials, the fonts, and all copies of them, in part and in whole, including modified copies, if any.
7 Misc
Content of EULA shall not be amended or changed by any way. Agreement shall be governed by the law of Hungary. Approval of content of Agreement is expressed by usage of font software. As a result of this, this Agreement is concluded.
Hungarumlaut expressly reserves the right to amend or modify subsequent versions of this License Agreement at any time and without prior notification.
