Digital type should be considered as software. Its use is protected by intellectual property law.
When purchasing a typeface font software, the purchaser does not get the ownership of the font but the license to use it. The purchaser gets the licence to use the font software to any computers as the license allows it.
.: Designers and Clients :.
The purchasing of font software allows unlimited use of the font within the terms specified in the End User Agreement. The designer agency, studio or any font user can use the font within any kind of work as many times as he/she wishes. Its unlimited use lets the designer use the font for any client according to his/her design project. But, under no reason, the designer will provide the font to his/her client. If the designers client company or whatever wishes to use the font, they are supposed to purchase their own license. Font software and its licence cant be transferred to third parties.
.: Modifying Font Outline :.
The purchaser is not allowed to modify or alter the font software without permission. However, under no circumstances may the resulting work be for resale or further distribution.

By purchasing and installing TipoType font software, you agree on all the terms specified within this End User License Agreement:
.: End User License Agreement (EULA) :.
1. Digital files installed to your computer contain font software that is the intellectual property of the fonts respective designer, represented herein by TipoType, that owns the rights for distribution and reserves all rights to intellectual property.
2. This license is for the benefit of a single user only. You may install and use TipoType font software on a total of not more than three computers. In case additional installation is required, a multiple license should be required
3. You are not authorised to rent, sell, lend, lease or give away the font software to another person or entity. It is not allowed sharing the fonts and making copies. Back-up additional copies of the font software are only allowed for exclusive archival purposes, provided you retain exclusive care and control over such copies..
4. You may take a digitized copy of the font software used in a particular document to a commercial printer or service bureau for its reproduction. Upon completion of document the service bureau must remove/erase the copy of the font software. The purchaser is responsible for securing this data and making sure that unlicensed copies do not leave his/her possession.
5. Embedding of font software into documents or internet pages is only permitted in a secured print/read-only mode. Editing and modifying content should not be allowed. You must ensure that recipients of such documents or internet pages cannot extract the font software or use the embedded font software for editing purposes or for the creation of new documents. A non-secure pdf document is only allowed when sending digital files to a service bureau for outputting purposes only.
6. You are not authorised to transfer font softwares license to another person or entity. Sublicencing is not allowed.
7. Modifying font outlines is allowed. (modifying outlines, new signs, alter spacing, change format, etc) only for its own personal or professional use. The purchaser is responsible for securing this data and making sure that unlicensed copies do not leave his/her possession.
8. TipoType warrants that the font software will perform in accordance with the specifications published by TipoType. Damaged or defective font software can be replaced when accompanied by the valid sales receipt and the user licence number within 30 day period after purchasing.
9. If you do not agree with the terms of this license, please return the software to TipoType.
10. TipoType thanks you for licensing font software. This is the only way to get some compensation according to the amount of time and energy that a new type design entails.

The Licensee may use the Licensed Webfont(s) only on the web, for styling Websites, using the @font-face selector in CSS files, subject to the following restrictions:
1. The Licensee may not link to, nor put online, any version of the font not supplied in a Webfont Kit.
2. The comments, showing copyright and other legal information provided in the sample HTML/CSS/Javascript files, for each Licensed Webfont used, must be retained in Licensees working website code.
3. The Licensed Webfont(s) may be used on any Website owned or controlled by the Licensee (subject to paragraph 4 below). The total traffic, measured in page views, of Websites on which the Licensed Webfont is used must be no greater than the number of page views per month specified in the receipt you received for the Licensed Webfont(s).
4. Agencies responsible for multiple clients Websites, for example web design agencies or hosting providers, may not share a single Webfont license across multiple clients Websites.
5. The Licensed Webfont(s) may be used in a Website, where visitors produce Styled Content by directly or indirectly selecting a Licensed Webfont and entering or editing text using that Licensed Webfont, subject to the following conditions:
5.1 The Website may not enable or facilitate the Styled Content being used outside said Website, including but not limited to producing merchandise, PDF documents, image files, or personalized physical objects.
5.2 The Websites font selection user interface must display the fonts original name(s) and cite MyFonts as the source of the Licensed Webfont(s).
6. The Licensee may not use conversion or editing tools on the Licensed Webfont(s).
7. Use of the Licensed Webfont(s) with webfont technologies other than @font-face, such as sIFR, Cufón or Typeface.js, is not allowed.
8. The Licensed Webfonts are the property of their respective owners. Unauthorized copying or use of the Licensed Webfonts is expressly forbidden. You may be held legally responsible for any infringement of intellectual property rights that is caused or encouraged by your failure to abide by the terms of this Agreement.
9. Termination
This Agreement is effective until terminated. This Agreement will terminate automatically without notice if you fail to comply with any provision contained herein.
10. Disclaimer and Limited Warranty
TipoType warrants the Product to be free from defects in materials and workmanship under normal use for a period of twenty one (21) days from the date of delivery as shown on your receipt. TipoType 's entire liability and your exclusive remedy as to a defective product shall be, at TipoType' option, either return of purchase price or replacement of any such product that is returned to TipoType with a copy of the invoice. TipoType shall have no responsibility to replace the product or refund the purchase price if failure results from accident, abuse or misapplication, or if any product is lost or damaged due to theft, fire, or negligence. Any replacement product will be warranted for twenty one (21) days. This warranty gives you specific legal rights. You may have other rights, which vary from state to state.
EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE PRODUCT, IS PROVIDED AS IS. TIPOTYPE DOESN'T MAKES ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
The entire risk as to the quality and performance of the Product rests upon you. TipoType doesn't warrant that the functions contained in the Product will meet your requirements or that the operation of the software will be uninterrupted or error free.
TipoType WON'T BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FROM LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE |
